Terms of Sale
These terms of sale apply to the purchase of goods and services from Hungry Heart Cafè AS via hungryheartcafe.no – including purchases in the online store, tickets for events, and catering orders. These terms, together with your order confirmed through an order confirmation, constitute the complete basis for the agreement of the purchase. The terms are prepared in accordance with Norwegian consumer legislation, including the Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, and the E-commerce Act.
1. The Agreement
The agreement consists of these terms of sale, information provided in the ordering system, and any separately agreed terms. In case of conflict, separately agreed terms take precedence, provided they do not conflict with mandatory legislation. The agreement is otherwise supplemented by relevant legal provisions governing the purchase of goods and services between businesses and consumers.
2. The Parties
Seller is Hungry Heart Cafè AS, Torget 5, 3256 Larvik, org. no. 913 919 580, email: tone@hungryheartcafe.no, phone: 906 31 779, hereinafter referred to as the seller.
Buyer is the consumer who places the order, hereinafter referred to as the buyer.
3. Prices
All prices are stated in Norwegian kroner and include value-added tax. The stated price is the total amount the buyer must pay. Any additional costs, such as delivery or shipping fees, will be disclosed in the ordering system before the order is completed.
4. Formation of the Agreement
The agreement is binding on both parties when the buyer has sent their order to the seller. However, the agreement is not binding if there has been a clerical or typing error in the seller's offer in the ordering system or in the buyer's order, and the other party was or should have been aware of such an error.
5. Payment
Payment is made via Vipps or payment card (Visa/Mastercard) in the ordering system. Tickets and orders in the online store are normally charged at the time of purchase. For catering orders, the seller may require a deposit at the time of booking; the deposit amount and other payment terms will be disclosed before the order is completed, and the remaining amount is paid according to the agreement, for example, upon collection or delivery.
6. Delivery and Collection
Goods purchased in the online store are delivered or made available for collection as soon as possible, and no later than 30 days after the order unless otherwise agreed. Delivery is considered complete when the buyer or the buyer's representative has taken possession of the goods.
Tickets for events are delivered electronically to the provided email address immediately after the purchase is completed.
Catering is delivered at the agreed time and place, or collected from the seller as agreed. Any delivery fee will be disclosed at the time of booking.
7. Risk of Loss
The risk of loss for the goods passes to the buyer when the goods are taken over by the buyer in accordance with the agreement.
8. Right of Withdrawal
For goods purchased in the online store, the buyer may withdraw from the purchase within 14 days of receiving the goods, in accordance with the Right of Withdrawal Act. The buyer must notify the seller of the use of the right of withdrawal within the deadline, preferably using the withdrawal form or another unambiguous declaration. The buyer bears the direct costs of returning the goods. The seller will refund the purchase price without undue delay and no later than 14 days after receiving notice of the use of the right of withdrawal, but may withhold the refund until the goods are received in return or the buyer has documented that the goods have been sent back.
The right of withdrawal does not apply to:
- goods that are liable to deteriorate or expire quickly, for example, fresh food (Right of Withdrawal Act § 22(d)),
- sealed goods that, due to health or hygiene reasons, are not suitable for return after the seal is broken after delivery, for example, food with a broken seal (§ 22(e)),
- catering and tickets for events or other leisure activities with a specified date or time period (§ 22(m)).
If the right of withdrawal is not disclosed where it applies, the withdrawal period is extended to twelve months.
9. Events and Tickets
Tickets are valid for the specified event, date, or time period indicated on the ticket and are not covered by the right of withdrawal, see point 8. If an event is canceled by the seller, the ticket price will be fully refunded. In the case of significant changes, such as a new date, the buyer may choose to use the ticket at the new time or receive a full refund of the ticket price. Lost or unused tickets are not refundable.
10. Catering
Catering orders are placed via the ordering system within the deadlines specified there and are binding once confirmed by the seller. Catering with a specified date or time period is not covered by the right of withdrawal, see point 8. Cancellation or changes must be agreed with the seller as soon as possible. If cancellation occurs less than 24 hours before the agreed delivery or collection time, the seller may claim compensation for incurred costs, including retaining the deposit paid in full or in part.
Disclose any allergies and food intolerances when placing the order. Information about allergens in our products is available upon request to the seller.
11. Delay and Non-Delivery
If the seller fails to deliver the goods or delivers them late in accordance with the agreement, and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the Consumer Purchase Act, depending on the circumstances, withhold the purchase price, demand fulfillment, cancel the agreement, and/or claim compensation from the seller.
12. Defects in the Goods
If there is a defect in the goods, the buyer must notify the seller within a reasonable time after the defect was discovered or should have been discovered, that they wish to invoke the defect. A complaint must be made no later than two years after the buyer took possession of the goods, or five years if the goods are intended to last significantly longer than two years. For food products, a complaint should be made as soon as possible. In the event of a defect, the buyer may, depending on the circumstances, demand repair or replacement, a price reduction, cancellation of the agreement, and/or compensation in accordance with the Consumer Purchase Act.
13. Seller's Rights in Case of Buyer's Default
If the buyer fails to pay or fulfill other obligations under the agreement, and this is not due to the seller or circumstances on the seller's side, the seller may, depending on the circumstances, withhold the goods, demand fulfillment of the agreement, cancel the agreement, and/or claim compensation, late payment interest, collection fees, and debt collection fees.
14. Newsletters and Marketing
The seller only sends newsletters and other marketing emails to recipients who have consented to receive them, in accordance with the Marketing Act. Consent can be withdrawn at any time via the unsubscribe link in the newsletter or by contacting the seller.
15. Personal Data
The seller is the data controller for personal data processed in connection with purchases and orders. The data is processed in accordance with our privacy policy and applicable data protection legislation.
16. Dispute Resolution
Complaints should be directed to the seller within a reasonable time. The parties shall attempt to resolve any disputes amicably. If this is not successful, the buyer can contact the Norwegian Consumer Authority for mediation, phone 23 400 600, www.forbrukertilsynet.no. The European Commission's complaint portal can also be used: ec.europa.eu/odr. Disputes will be resolved under Norwegian law.
